BENEFITS FOR THE NOW DIVORCED PREVIOUS SPOUSE OF THE DECEASED WORKER
If you were previously married to and are now the divorced former spouse of a now deceased former wage earner you can still receive widow/widower’s benefits if the marriage lasted at least 10 years or longer and you are at least 60 years old (or age 50 and disabled). NOTE: If you have been married for a period less than the prescribed 10 year period you can still be awarded and otherwise entitled to widow’s and widower’s benefits if you can properly establish that: (1) you are providing care to a child under age 16 &/or is disabled and also receiving benefits on the social security record of the deceased former spouse; and (2) such child is your deceased former spouse’s naturally or legally adopted child. NOTE: benefits paid to a surviving divorced spouse will not reduce the benefit amounts for any other survivors receiving benefits under the deceased worker’s account unless you qualify merely because you have your deceased spouses minor or disabled child in your care.
Generally you cannot receive survivors benefits if you remarry before the age of 60 unless this later marriage legal ends by death, divorce, or annulment. If you get remarried after you reach the age of 60 (or age 50 if you are disabled) you can still receive benefits on your deceased former spouse’s account record. When you reach age 62 you may choose to receive retirement benefits on the record of your new spouse if these benefits will be higher.
